A new program is now underway that will help inventors and small businesses get donated legal services from patent attorneys.

Burlington Generator is a space where inventors and entrepreneurs can work on their various projects without having to invest in office space. Just the kind of folks who could benefit from a new program made possible by the Leahy-Smith America Invents Act. It requires the U.S. Patent and Trademark Office to work with law associations to create programs to connect small businesses and inventors with patent attorneys willing to help them free of charge.

"It really is simple. You have on the one hand, low-income inventors who have really good ideas but don't have the resources to hire patent lawyers; on the other hand, you have patent lawyers who are willing to give away their services for free, " said Jennifer McDowell of the U.S. Patent and Trademark office.

Vermont's program is part of a regional New England effort. Overall, there are 49 states enrolled.

"Every small business, every entrepreneur ought to have the opportunity to go before the patent office and secure their rights and I know you agree with that, " said Sen. Patrick Leahy, D-Vermont.

Entrepreneurs like Matt Flego from M&E Design.

"I produce prototypes of all kinds, " said Flego.

Flego says he would like to get a patent, but can't afford the cost, about $10, 000.

"I have a few inventions that I would like to get out in the market, and I am not at the point in my business yet where I can break through the $10, 000 barrier, " said Flego. "Typically it is about $10, 000 to get through the patent system, and if you can't come up with that money, you're basically out of luck."

The patent pro bono program should help, but it is not a guarantee of success. The average time it takes to get a patent is almost 27 months. And there are no numbers of just how many of those patent holders have gone on to commercially produce their products. Still, the program provides a big boost to at least start the process.
